What happens after a planning decision?

Even when approval is granted, it does not always mean you can start building immediately.

Planning conditions

Most approvals include conditions that must be discharged before or during development.  

Community Infrastructure Levy (CIL)

Most new homes or extending a building by more than 100sqm are liable for CIL, which helps fund:

• schools
• transport
• community facilities.

Section 106 agreements

Larger schemes often require a section 106 agreement to secure:

• affordable housing
• infrastructure contributions
• mitigation measures

These are legally binding and usually completed before permission is issued.

Why this catches people out

CIL and section 106 apply regardless of profit. They should be considered early, not after approval. If permission is refused you may:

• submit a revised application
• seek pre-application advice
• appeal to the Planning Inspectorate
