Notes
The distribution of free literature in Brent is controlled by the Clean Neighbourhoods and Environment Act 2005 S.23. Brent Council may designate roads, car parks, recreation grounds, etc as places where free literature may not be distributed without the Council's consent.
Literature that is being sold in the street is covered by the London Local Authorities Act 1990 as amended by the 1994 Act.
Free literature means any newspaper, document, card or other literature for which no charge is made and which contains or comprises of an advertisement for commercial gain.
Free literature can:
- be placed in letterboxes but not fixed to vehicles.
- be distributed where it relates to a registered charity or a political organisation or where it relates to services provided by London Regional transport or its subsidiaries.

Charges
Offences and penalties
Any person who distributes free literature in a designated place without the consent of the Council or causes or permits any person he commits an offence and shall be liable on summary conviction in the magistrates court to a fine not exceeding level 4 on the standard scale currently £2,500. FPNs can be discharged by payment of £75.
Any person who breaches conditions attached to any consent shall be guilty of an offence and liable on summary conviction to a fine not exceeding £500. Where a person is distributing free literature in a designated place without the consent of the council, an authorised officer may seize any supply of that literature which the person has at or near that place.
